Defect Types & Actions
Venting or Drain Grade Issue (Critical builder defect) — Sewer gas smell and gurgling in new construction almost always indicates improper venting (missing vent stack, incorrect AAV, code violation) or incorrect drain slope. FBC requires 1/4" per foot slope for horizontal drain runs. FBC Plumbing Chapters 7 and 9 apply. Record video with audio of gurgling, document the odor with dates/times, photograph backups; have a licensed FL plumbing contractor issue a written defect report citing FBC violations. Year 1 warranty defect.
Undersized or Improperly Graded Drain System (Possible defect) — Multiple drains slow from day one indicate improper pipe sizing, insufficient slope, or installation defect. FBC requires minimum drain sizes by DFU. A camera inspection confirms incorrect slope, construction debris, or undersized pipe.
Potential Slab Leak (Time-sensitive) — Warm floor, wet slab, unexplained water bill increase, or meter moving with fixtures off in a home under 10 years may indicate a slab leak. FL causes: aggressive soil pH corroding copper, construction vibration, poor solder joints, PEX manifold failures. May fall under FL FS 553.835 structural warranty. Run the water meter test, get acoustic leak detection BEFORE cutting concrete.
Water Hammer / Improper Pipe Securing (Warranty issue) — Indicates missing/undersized water hammer arrestors or pipes not secured to framing per FBC. Builder responsibility under 1-year workmanship warranty.
Shower Pan Leak (Critical mold risk) — Indicates improper pre-pan liner, failed waterproofing membrane, or insufficient mortar bed slope. FBC requires shower pans flood-tested 24 hrs before tiling — a skipped test is direct defect evidence. In FL climate, 24–48 hrs of moisture creates active mold. Stop using the shower; pull permit records to verify flood test inspection.
FL Builder Warranty Tiers
- Year 1 — Full Workmanship & Materials Warranty: Builder must repair/replace all defective workmanship, materials, and improper installation across all systems. Broadest window.
- Years 1–2 — Major Mechanical Systems Warranty: Plumbing, electrical, HVAC typically covered 2 years under FL warranties and FS 553.835.
- Years 1–10 — FS 553.835 Implied Structural Warranty: 1 year workmanship/materials; 2 years mechanical/electrical/plumbing; 10 years structural (foundation, load-bearing walls, slab). Slab leak causing structural damage enforceable under 10-year warranty.
- Statute of Limitations (FS 95.11): ~4 years for latent (hidden) defects from date of discovery; 10 years for structural. Clock starts at discovery.
FS 558 — Construction Defect Notice Process (Mandatory)
Before suing a builder for a construction defect in Florida, you MUST send a written notice of claim under FS 558.004. Failure can result in dismissal.
- Send Written Notice of Claim to Builder — Detailed written notice to GC and known plumbing subcontractor identifying each defect (location, description, code/warranty violation). Certified mail, return receipt, to registered agent (sunbiz.org).
- Builder Has 45 Days to Inspect & Respond — Do not make repairs yourself without documenting existing condition; permit the builder's inspection.
- Review Builder's Written Response — Builder may offer repair, monetary settlement, dispute, or combination. Not required to accept.
- Negotiate, Mediate, or Proceed to Legal Action — Mediation (often required by contract), binding arbitration, or civil lawsuit.
- Watch the Statute of Limitations — Notice must be sent within applicable SOL (~4 years from discovery). FS 558 process may toll the period.
Who to Send the FS 558 Notice To
- General contractor (builder of record) — certified mail to registered agent via sunbiz.org
- Licensed plumbing subcontractor (if known) — send separately
- Design professionals if their specs contributed
- Title insurance company if defect affects marketability
- Keep all certified mail receipts and delivery confirmations
DBPR Complaint Process
If the licensed plumber who installed your plumbing did defective work, file a complaint with FL DBPR. Online: myfloridalicense.com → File a Complaint → Construction Industry. Outcomes: license suspension, fines, required remediation, probation. DBPR records are public and citable in FS 558 negotiations. A complaint does not replace FS 558 notice — pursue both.
Hiring an Independent Plumbing Inspector
A written defect report from a licensed FL plumbing contractor (not the builder's plumber, not a home inspector) is your most powerful evidence.
A complete FS 558-ready defect report must include: Inspector's FL plumbing contractor license number and company; specific FBC sections violated by chapter/section; timestamped photos with location notes and measurements; itemized repair cost estimate per defect; written opinion that defects are construction-related; date and method of inspection; test results (pressure, drain camera footage); signed/dated on contractor letterhead with license number.
Documentation Toolkit / Checklist
- Photographed each defect with date/timestamp (metadata)
- Recorded video of active defects (gurgling, drips, wet slab, pipe banging)
- Completed the water meter test
- Noted earliest date each defect was first observed
- Pulled permit records from county (confirm inspections passed)
- Contacted builder in writing (email/certified mail; phone calls don't count)
- Received written diagnosis from a licensed FL plumber (not handyman/inspector)
- Located and reviewed closing warranty documents
- Reviewed HOA documents if applicable
Water Meter Leak Test — Step by Step
- Turn off ALL water completely (faucets, dishwasher, washer, ice maker, irrigation, misters).
- Locate and photograph the water meter (note all digits + low-flow indicator).
- Do not use any water for exactly 2 hours.
- Return and photograph the new reading.
- Any movement = hidden leak. Save both timestamped photos as evidence for FS 558 notice.
County Permit Records — Pull Inspection History
A skipped or failed plumbing inspection that was not corrected is significant evidence in a FS 558 claim. FS 558 Notice Template Guidance
Key elements: full legal name and property address (as on deed); specific description of each defect with code citation; location within home; date first noticed; reference to attached documentation; request for repair/remedy; send to builder's registered agent via certified mail. Example: "The master bathroom shower drain emits hydrogen sulfide odor consistent with improper trap or vent installation in violation of FL FBC Plumbing Section 904.1..." Consider having a FL construction defect attorney (often contingency, free consults) review before sending.
