FL Septic Rules & Permits

Quick setbacks: 75 ft from potable well; 10 ft from property line; 5 ft from foundation; 5-yr pump-out cycle.

FL Statute 381.0065 - Septic Authority: Grants the FL Department of Health (FDOH) authority over onsite sewage treatment and disposal systems (OSTDS). All OSTDS must be permitted and inspected by the county health department before installation. Permits required for new systems, repair, modification, and abandonment. Systems must comply with FAC 64E-6 minimum standards. Counties may impose stricter requirements. Penalty for operating without a permit: civil fine up to $5,000 per day.

Outstanding Florida Waters (OFW) require 100 ft setback for drain fields.

FS 381.00655 - Mandatory Pump-Out: FL law requires septic tanks to be pumped at minimum every 5 years. New-home exemption: first pump-out due within 5 years of installation. Owner must retain records 5 years. Some counties (Pinellas, Indian River, Sarasota) enforce more frequently. Cost typically $250-$450 for standard residential pump-out.

Permit Process - Step by Step: (1) Site Evaluation by FL-licensed soil evaluator/engineer ($300-$600); (2) Application Submission - FDOH Form DH 4015 with site plan, soil evaluation, fee; (3) Plan Review (5-15 business days); (4) Permit Issued (valid 18 months); (5) Installation by FL-licensed septic contractor (CPSC or MRC); (6) Final Inspection - Certificate of Completion; (7) Operating Permit issued after passing.

Environmentally Sensitive Areas: OFW (100 ft drain field setback, PBTS may be required); Springs Protection Areas (advanced N-removal); Florida Keys/Monroe Co. (stringent nitrogen removal); Aquifer Protection Zones; WBID Impaired Waters (nutrient TMDL); coastal setback lines (DEP coordination).

System Abandonment Requirements: When connecting to public sewer or replacing, an OSTDS abandonment permit is required. Tank pumped by licensed contractor, then crushed/filled with clean sand/gravel or removed; drain field pipes removed/crushed; certificate of abandonment issued. Cost $300-$800 plus contractor fee. Do NOT abandon without a permit - fines up to $5,000.
